1. About CARIUSB

CARIUSB is an AI-powered car visualization platform operated by Powius Ltd, a company registered in England and Wales. The service allows users to generate photorealistic modifications of vehicle images and videos using artificial intelligence, including color changes, body kit applications, rim swaps, window tinting, background replacements, and cinematic video clip generation. The service may also include a public Community feed where users can share their creations.

CARIUSB acts as a passive intermediary for user-generated content and does not actively monitor all submissions. We will remove or disable access to infringing or violating content promptly upon receiving a valid notice.

By accessing or using CARIUSB (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to create a free account and use the Service. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to make any purchase, including subscription plans or Boost Credits. By completing a purchase, you confirm that you meet this age requirement. If you are between 13 and 18, you confirm that you have obtained permission from a parent or legal guardian to use the Service.

By creating an account, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.

3. Accounts

• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate, current, and complete information when creating an account and keep it up to date.
• You must notify us immediately at contact@cariusb.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to other users or the platform.

4. Subscriptions, Credits, and Billing

CARIUSB offers both monthly and annual subscription plans, as well as one-time Boost Credit purchases. Operations are consumed per feature applied — each individual modification (such as a color change, rim swap, or background replacement) counts as one separate operation, regardless of how many features are applied in a single session.

• Monthly operations reset at the start of each billing cycle and do not roll over to the following month. Unused operations are forfeited at the end of each period and are not refundable.
• Boost Credits are one-time purchases available on Sport+ and above plans. They are consumed automatically once your monthly operations are exhausted. Boost Credits expire 3 months from the date of purchase. Unused credits after this period are permanently removed.
• Subscription cancellation and Boost Credits: if you cancel your subscription, any remaining Boost Credits will be frozen for 3 months from the cancellation date. If you resubscribe within that window, your credits will be restored. After 3 months, frozen credits are permanently deleted.
• Downgrade and Boost Credits: if you downgrade to a plan that does not support Boost Credits (below Sport+), your remaining credits are held and not consumed. The 3-month expiry window continues to run. Credits become accessible again if you upgrade back to Sport+ or above before they expire.
• Account deletion and credits: if you delete your account, all remaining monthly operations and Boost Credits are permanently and immediately deleted. They cannot be recovered.
• Annual billing is charged upfront for the full year at a discounted rate. No partial refunds are issued for unused months on annual plans.
• Payment processing is handled by Stripe. By purchasing a subscription or credits, you agree to Stripe's terms and authorize recurring charges (for subscriptions) or a one-time charge (for credits).
• Fraud and abuse: we reserve the right to revoke or reduce credits, suspend, or permanently ban accounts if we detect fraudulent purchasing, chargebacks, abuse of the Service, or violations of these Terms.

5. Acceptable Use

You agree to use CARIUSB only for lawful purposes and in a manner consistent with these Terms. You must not upload, generate, distribute, or share content that:

• Sexualizes, exploits, or harms minors in any way, including CSAM or CSEM.
• Is pornographic or sexually explicit.
• Promotes, incites, or glorifies violence, hatred, racism, discrimination, or harassment against any individual or group.
• Creates deepfakes, synthetic media, or AI-generated likenesses of real individuals (including public figures) without their explicit written consent.
• Infringes any copyright, trademark, patent, trade secret, or other intellectual property or privacy rights of any person.
• Is defamatory, fraudulent, misleading, or otherwise unlawful.
• Contains malware, viruses, or other harmful code.
• Violates any applicable local, national, or international law or regulation.
• Contains clearly visible vehicle licence plates, personal identification documents, or recognisable likenesses of individuals who have not consented to their image being uploaded, processed, and potentially published through the Service.

We reserve the right to remove any content that violates these rules. We may suspend or terminate accounts of repeat infringers without notice or refund. This repeat infringer policy applies to violations of intellectual property rights as well as other prohibited content under these Terms.

6. Community Feed

• Content shared to the Community feed is public and visible to all visitors, including non-registered users.
• By sharing to the Community, you grant Powius Ltd a non-exclusive, royalty-free, worldwide license to display and distribute that content within the platform.
• You may delete your own Community posts at any time; we will remove them from the public feed promptly, subject to any technical propagation delays or legal retention requirements.

All content submitted to the Community feed is subject to automated and/or manual review prior to publication. We reserve the right to reject, remove, or restrict any content that violates these Terms or our Community Guidelines without prior notice. Users may report content they believe violates these Terms by contacting contact@cariusb.com. We will review all reported content and, where a violation is confirmed, take appropriate action within a reasonable timeframe. We moderate Community content at our sole discretion.

7. Your Content and AI Outputs

• Your uploads: You retain all rights to content you upload to the Service. By uploading, you grant Powius Ltd a limited, non-exclusive, worldwide, royalty-free license solely to process, host, and deliver your content as necessary to provide the Service.
• Generated outputs: You may use AI-generated outputs for personal and commercial purposes. You are solely responsible for ensuring your use does not infringe third-party intellectual property, privacy, or other rights.
• Marketing use: We will not use your private uploads or generated outputs for marketing, advertising, or promotional materials without your explicit opt-in consent.
• AI limitations: AI-generated outputs may be imperfect, unexpected, or unintended. We do not warrant the accuracy, quality, or fitness of AI outputs for any particular purpose.
• Third-party marks: AI-generated outputs may contain third-party trademarks, logos, or brand identifiers present in your original uploaded image (for example, vehicle manufacturer logos). Powius Ltd makes no warranty that such outputs are cleared for commercial use. You are solely responsible for ensuring that any downstream use of outputs containing third-party marks complies with applicable intellectual property law and does not require additional clearance.

By uploading any content to the Service, you represent and warrant that you hold all necessary rights, licences, and permissions to upload and process such content through the Service, and that doing so does not infringe any third-party intellectual property, privacy, defamation, or other rights. Powius Ltd bears no responsibility for content uploaded in breach of third-party rights.

8. Intellectual Property

The CARIUSB platform, brand, logo, software, and all associated technology are the intellectual property of Powius Ltd and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without our prior written consent.

9. Service Availability and Modifications

We strive to maintain a reliable and high-quality service, but we do not guarantee that the Service will be available at all times, uninterrupted, or free of errors. We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. Where possible, we will provide advance notice of material changes.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or that AI-generated outputs will be accurate, complete, or appropriate.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Powius Ltd, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to Powius Ltd in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.

12. Indemnification

You agree to indemnify, defend, and hold harmless Powius Ltd and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit, post, or transmit through the Service.

13. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal information.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory applicable law in your country provides for a different jurisdiction. Nothing in this clause affects any statutory rights you may have as a consumer under the mandatory consumer protection laws applicable in your country of habitual residence, including the right to bring proceedings before the courts of that country.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify you by email. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
